Auriga Law Chambers is known for being the best lawyers for Bounced Cheques. Under Section 138 of the Negotiable Instruments Act, 1881 ("Act"), a cheque bounce is an offense punishable by a fine of up to double the value of the cheque or imprisonment for up to two years, or both. A cheque is said to have bounced when it is presented to a bank for payment and is returned unpaid with a memo of insufficient funds. A cheque might bounce for a variety of reasons, but it is an offense under the Act if it bounces due to insufficient money in the drawer's account. The bank must reject the cheque and provide a return memo noting insufficient funds as the cause. In this instance, the payee of the cheque can send the drawer a cheque bounce notice demanding that the cheque amount be paid.
